What the tribunal said
The tribunal determined that the open market rent for the property in modernised, good condition would be £1,050 per month. Under section 14(2)(b) of the Housing Act 1988, tenant improvements must be disregarded when determining the rent. The tribunal accordingly deducted approximately 7.5% from the market rent to reflect the property's unimproved condition, determining the market rent at £970 per month.
The property
The property was in a very basic condition when the tenancy commenced. The tenant carried out substantial improvements including replacing the kitchen, renovating the bathroom with a new suite and shower, laying new flooring, and painting.
