Comparable modern two-bedroom flats in the area achieve rents between £1,100 and £1,300 per month. The subject flat suffers from significant drawbacks including an inconvenient layout across two storeys above a commercial unit, lack of parking, dated basic fittings, and dampness. The tribunal determined a market rent of £750 per month and deferred the effective date to 17 January 2025 due to undue hardship.

The property

The property features dated and basic kitchenette and bathroom facilities without extractor fans. Dampness and mould were observed in the kitchenette and bedrooms, alongside condensation issues. There is a lack of insulation above the shared passageway beneath the floor of the double bedroom. Externally, gutters, downpipes, pointing, and the ceiling of the shared passageway require repair. Thin and worn carpets were provided by the landlord.
