What the tribunal said
The tribunal established an initial open market rent of £2,500 per month assuming the property was in good tenantable condition with landlord-provided floor coverings and white goods. To reflect the actual condition and tenancy terms, deductions totaling £840 per month were applied for tenant-supplied carpets/flooring (£100), tenant-supplied white goods (£40), leaking bath/shower (£200), excessive mould throughout (£250), poor decoration and ceiling holes (£150), and general disrepair (£100), resulting in a determined market rent of £1,660 per month.
The property
The property is in very poor overall condition with severe condensation and widespread black mould throughout the living spaces and attic space. There are leaks from the attic causing ceiling holes, leaking bath and shower fittings, blown double glazing, ill-fitting windows, a damaged entrance door, and defective or missing floor coverings in several rooms. An improvement notice was previously issued by the local authority regarding mould and moisture.
