What the tribunal said
The landlord proposed a rent increase from £700 to £995 per month under section 13. The tenant referred the notice to the tribunal. The tenant had consistently refused access to the landlord for inspections and repairs. Following legal precedent, the tribunal held that a tenant cannot rely on disrepair resulting from their own refusal to allow access. Disregarding the disrepair, the tribunal determined the open market rent to be £800 per month.
The property
Property is in need of general refurbishment and decoration. Kitchen and bathroom are in generally good condition but require updating. Defects include minor holes at lower levels, stiff doors and windows, exposed pipework needing boxing/replacement, a leak from the bathroom to the living room ceiling, and a loose tap. The tribunal made no deduction for disrepair because the tenant breached tenancy terms by refusing the landlord access to carry out repairs.
