What the tribunal said
The tribunal concluded that the open market rent was significantly reduced by ongoing structural cladding works, scaffolding, and serious fire safety deficiencies requiring a waking watch. Consequently, market rent was determined not to exceed the passing rent.
The property
Scaffolding and ongoing fire remedial cladding works caused noise, dust, loss of privacy and natural light, vermin, and restricted balcony access. Faulty fire safety system with non-functional fire alarms required a waking watch. Minor redecoration issues in communal lobby and periodic lift breakdowns were also noted.
