What the tribunal said
The tribunal determined that an unadjusted market rent for the property in good condition would be £4,000 per month based on comparable market evidence. A 30% deduction (£1,200) was made to reflect subsidence damage and the lower value of the low-ceiling basement rooms, resulting in a market rent of £2,800 per month. The effective date was set to the decision date due to undue hardship as the tenant receives Universal Credit.
The property
The property suffers from subsidence damage caused by tree roots. The basement contains a room and bathroom with low ceiling heights below 2.05m.
