What the tribunal said
The tribunal determined that the open-market rent for the property in good order would be £1,000 per month. It deducted £100 per month for the interior condition, giving an adjusted market rent of £900 per month. Under section 14ZB(5) of the Housing Act 1988, where the market rent exceeds the proposed rent, the rent is capped at the proposed amount of £875 per month. The tribunal found no undue hardship to defer the starting date.
The property
The interior of the property was tired, with peeling lounge ceiling wallpaper and dampness around the kitchen window. Maintenance disputes were noted regarding bathroom tiling, side windows, and linoleum flooring.
